Video Evidence for Questionable Injury Claims

Fraudulent and exaggerated workers’ compensation claims can ruin Los Angeles businesses both large and small. Even a single questionable claim may lead to increased insurance premiums, higher X-mods, costly litigation, and unnecessary pressure on employers who are already trying to operate in one of the most expensive business environments in the country.

At Paramount Investigative Services, we specialize in workers’ compensation fraud investigations throughout Los Angeles county. Our goal is to help employers, self-insured businesses, and defense attorneys uncover evidence that shows a claimant’s true physical abilities, daily activity level, and lifestyle. Through careful surveillance, we prove whether or not their claims of physical limitation are accurate – and most of the time, they're not!

In California, what many people call “fraud” may not always meet the legal standard for fraud or “MILK” but strong surveillance evidence helps reduce exposure, mitigate inflated claims, and support a stronger defense strategy. An exaggerated claim can often be just as fiscally damaging as a downright fraudulent one – so no matter the severity of the lie, it's still crucial to obtain evidence proving the reality of the situation.

Los Angeles Workers’ Compensation Fraud Investigators

Workers’ compensation fraud investigations in Los Angeles require speed, discretion, and decades of experience to complete efficiently and accurately. Claimants may allege that they cannot lift grocery bags, bend at the waist, walk without a limp, drive, work, or perform basic daily tasks. However, what they tell doctors, attorneys, employers, and insurance representatives may not match what they do when they believe no one is watching – we uncover that truth, beyond any reasonable doubt.

Our investigators work to document inconsistencies between a claimant’s reported limitations and their actual activities. We aim to acquire video evidence of a supposedly disabled worker often performing the very physical tasks they've claimed they can't perform! Tasks such as lifting groceries, walking up steps, etc. There's no stronger evidence than HD video showing an “injured” person performing the very actions they're claiming in court they're incapable of doing!

In a city as large and active as Los Angeles, effective workers’ compensation surveillance requires more than simply sitting outside a residence during business hours. We identify likely windows of activity, develop a targeted surveillance plan, and focus investigative time where it is most likely to produce useful evidence.

Why Immediate Investigation Matters

Timing is critical in suspected workers’ compensation fraud cases. Early in a claim, subjects are often less careful and less committed to maintaining a false narrative. Over time, they may become more guarded, alter their routines, and start to believe their own lie. The longer you wait, the better the act becomes, and the harder it is to catch them slipping up.

Frequently asked questions of Work Comp Fraud investigators

  1. Can an employer hire a private investigator directly?

Yes! We highly encourage the employer to hire us. The employer are the ones with the personal connection and likely have knowledge of what these people used to do for hobbies. They may have images from past gatherings and likely know what they drive for work. So yes, we strongly encourage the employer to hire the PI themselves. Why wait for the insurance company or have information lost in translation between the insured, the TPA, the SIU and then the investigator!

  2. Is there a difference between a normal surveillance and workers compensation fraud surveillance?

Typically workers comp surveillance is done to see if a person is doing activities outside of their restrictions or to see how they are recovering. When it comes to workers comp fraud surveillance it is all about strategy between doctors appointments, depositions and surveillance investigators.

  3. When it comes to Workers Compensation fraud what does the term “MILK” stand for?

Materiality, Intent, Lie and Knowledge. This is where workers comp fraud differs from other insurance fraud. In the workers compensation arena you have to prove they had intent to fraud the system.

  4. The employer needs to listen to the experts Vs. letting their emotions get the best of them.

We say this as the above image of the man gardening was obviously a fraudster. His past job duties were to listen to his employer and run errands. However his restrictions were so extreme that it in itself was a red flag. We did the surveillance and captured 3hrs of video doing things well beyond what he's telling his Doctors. The employer took the video and showed everyone as if we caught the injured worker red handed. Sadly, the young mans attorney amended their filing and the young man ended up back qt the employers warehouse. Talk about a lose lose.
