What are Cohabitation Investigations?

A cohabitation investigation refers to the process of determining whether two individuals are living together in a relationship that qualifies as cohabitation under the law within their jurisdictions. This typically involves examining living arrangements, lifestyles and work situations.  Often times, we work these cases like we would an insurance fraud case; we take what we know to be lies and we prove that the subject of the investigation was less than truthful the last time they were in court.

Why Are Cohabitation Investigations Important?

Cohabitation investigations are frequently conducted in cases involving alimony, child support, and in some states: divorce settlements. The primary purpose is to determine whether a person is living with a partner in a relationship that could impact financial obligations or legal entitlements. In divorce cases, one spouse might claim that alimony payments should be reduced or terminated because the recipient is cohabiting with a new partner (sharing living expenses).

Cohabitation Case Example:

These are prime examples of a cohabitation surveillance.  Let’s say the subject testified in court that they cannot afford to live on their own and that they live with family.  Their family also watches the children to help the subject make ends meet.  However, you know this to be a lie as you are close with friends of friends who’ve told you otherwise.  Our database and online research would get us new addresses and if they are in fact with a new person.  Once we have that information, we’ll perform surveillance.  With any luck we’ll capture them leaving their new residence with or without the child and then to childcare and or work.  This would show the subject lives on this own or with someone else who’s sharing expenses. This tells the courts that the subject has in fact lied to them.

The second most popular cohabitation cases would be that the subject doesn’t work at all and yet you know they do and their lifestyle demonstrates that it far exceeds their reported income.  Especially cases in Mega metropolitan areas.  It’s simply too expensive to not work; rent, cars, food etc.  Clearly, we would perform online research and gather what we can from social media accounts and a few days of surveillance.  Some investigations may require us to collect the subject’s trash in hopes of finding receipts and paystubs. Ideally our online research would show them with a nice house or apartment, expensive cars and the surveillance would confirm it.  We’d capture them driving the Bentley and or going to work. And again, all of this would demonstrate to the courts that they’ve been misled.
