It is not illegal for a licensed private investigator to perform surveillance investigations with regards to child custody issues.  In fact, it is one of our main sources of case work. Often times we perform surveillance to see who the child is with or if the ex is working or not and lastly are there any court orders being violated?

What is the most important factor in child custody cases?

The most important factor is having court orders outlining what the two parties have been ordered to do; Visitation, stay away orders and or no drinking orders.  If the judge didn't order it and or the parties didn't agree upon terms, then it doesn't matter if we capture video of the parent having a glass of wine or beer (As that in itself isn't against the law.)

How is child custody determined in Los Angeles?

There is no straight forward answer to this question as each situation is different. You must consider the following factors; age of the kids, the more stable environment, the parents income and more.  The courts ideally want to keep the family unit together the best they can.

How do I get full custody in Los Angeles?

Sadly, you won't get full custody unless your partner doesn't want custody or ex spouse has an extreme criminal record or a known history of substance abuse. Something else to be mindful of is each courthouse and each judge are different. Though typically cases are similar, the difference makers are your judges and your attorneys ability to negotiate your specific situation.

How long do child custody investigations take?

Child custody investigations typically take two to three days and budget permitting. However, more extreme cases may be investigated over the course of a couple of years.

Who wins most child custody cases?

Judges want the child to have a resemblance of a “Family Unit”. That means that the courts typically want the mother and father in the child's life. When it comes to who gets more custody, that would be determined by many factors; living situations, safe environment, schools, jobs, income etc.
